Who has to comply with HIPAA?

Any individual or organization that must comply with HIPAA is known as a covered entity. Covered entities include the following:

  • Health Care Providers: A provider of any size who electronically transmits personal health information as a part of transactions involving claims, benefits inquiries, referral requests, and other types of transactions defined by HIPAA.

  • Health Plans: Plans involving health, dental, vision, prescription drugs, Medicare, Medicaid, and long-term care; plans sponsored by employers, multi-employers, the government, and churches; and other plans.

  • Health Care Clearing Houses : Organizations that connect providers with plans and ensure that the information submitted by providers is factually accurate and correctly formatted before it proceeds on to health plans.

  • Business Associates: Individuals or organization who use or disclose personal health information as part of services such as analyzing data, processing claims, billing, etc.
